1. Applicability

1.2. Every offer of a BB My Champ product on our Site as well as every transaction, order and agreement that is concluded through our Site is governed by our BB My Champ Terms.

1.3. The applicability of any terms and conditions of the customer or any third party on behalf of the customer is expressly dismissed and shall not apply, even if BB My Champ has not specifically rejected them.

1.4. BB My Champ reserves the right to make changes to this Site and to these BB My Champ Terms at any time without prior notice. You should review these BB My Champ Terms each time you access this Site

2. Your Account
The customer is responsible for creating their own Account on our site. The customer will at all times be responsible for each and every use of the account. BB My Champ has the right to refuse any request made by you and to close your BB My Champ account immediately in the event of any breach of these BB My Champ Terms.

3. Terms of Sale
3.1. All our offers and promotions are without any obligation and subject to availability and confirmation of the order. An agreement between you and BB My Champ is subject to our acceptance of the order and will be formed when you receive the Order Confirmation by email.

3.2. Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the product (or any part or content thereof) without notice at any time.We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the product.

3.3. Certain products may have limited quantities and are subject to return or exchange only according to our Return Policy.

We have made every effort to display as accurately as possible the colours and images of our products that appear on our website. We cannot guarantee that your computer monitor will display the colours accurately.

We reserve the right to limit the quantities of any products that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of BB My Champ. We reserve the right to discontinue any product at any time. Any offer for any product made on this site is void where prohibited.

We do not warrant that the quality of any products purchased or obtained by you will meet your expectations, or that any errors in the products will be corrected.

5. Shipping and Delivery

5.1. When you purchase goods from our Site, delivery will take place as soon as reasonably possible. Delivery times may vary due to unforeseen circumstances. Please note that delivery times do not include weekends and public holidays.

5.2. You will be required to pay delivery charges in addition to the price for the goods you purchase.

5.3. You are required to provide us with a complete and accurate delivery address, including the name of the recipient. We are not liable for the delivery of your goods to the wrong address or wrong person as a result of you providing us with inaccurate or incomplete information.

6. Copyrighted Materials for Limited Use

6.1. This Site and all Content are the copyrighted property of BB My Champ or the copyrighted property of parties from whom BB My Champ has licensed such property. All rights in this Site and its Content are reserved worldwide.

6.3. BB My Champ reserves the right to add to, delete from, or modify any part of Content at any time without prior notice. The Content remains the property of BB My Champ and its licensors.

7. Use of our Site and its Content

7.1. You are granted permission to access and use this Site and its Content for the sole purpose of ordering products solely through BB My Champ. No other download, retention, use, publication, or distribution of any portion of the Content is authorised or permitted. Obtaining Products from BB My Champ does not entitle you to use any portion of Content apart from the Products as they are supplied by BB My Champ.

7.2. You agree to use this Site in a responsible manner that is in full compliance with these BB My Champ Terms and with the local laws and regulations.

7.3. BB My Champ reserves the right, in BB My Champ’s sole discretion, to refuse to process any order at any time and for any reason. BB My Champ also may terminate its service to and/or the accounts of customers found to be using BB My Champ to engage in undesirable activities or otherwise violating these BB My Champ Terms. You agree that BB My Champ shall have no liability of any kind to you or to any third party arising from such refusal or termination.

7.4. By placing an order on this Site, you warrant that you have all necessary permission, right and authority to place the order.

7.5. You agree that you are responsible for protecting your password and controlling access to your registered account. You agree that you will be responsible for all orders placed or other actions that are taken through your registered account.

8. Transfer of Title

6.1. The customer agrees that the risk of loss and title for any Product pass to you upon our delivery to our carrier.

9. Indemnification

You agree that you shall indemnify BB My Champ and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

10. Disclaimer of Warranty

The site and its content are provided “as is” without warranty of any kind, either expressed or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, or non-infringement. You acknowledge that operation of the site may not be uninterrupted or error free. While we make reasonable efforts to accurately display the attributes of products, we do not warrant that product descriptions are accurate, reliable and error-free.

11. Refunds

Refund for Goods
Refund requests must be made within 7 days of receipt of your goods. Refund requests cannot be made for reasons such as ‘change of mind’.
Due to health and safety concerns, refund requests may not be approved.

12. Limitation of Liability

In no event shall BB My Champ, our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

13. Site Feedback

Any comments, suggestions, proposals or other feedback (collectively “Feedback Information”) provided to BB My Champ in connection with the operation or content of this Site shall be provided by the submitter and received by BB My Champ on a non-confidential basis. All such comments, suggestions, and other information shall become the exclusive property of BB My Champ. You agree that BB My Champ shall be free to use such information on an unrestricted basis.

15. Miscellaneous

You must be at least 18 years old or otherwise have parent or guardian permission to use this Site. By using this Site, you represent and warrant that you are at least 18 years old or have that permission. In the event any provision hereof is found to be unenforceable by a court of competent jurisdiction, that provision shall be deemed modified to the extent necessary to allow enforceability of the provision as so limited, or, if a deemed modification is not satisfactory in the judgment of that court, the unenforceable provision shall be deemed deleted, and the validity and enforceability of the remaining provisions shall not be affected thereby.

16. Governing Law, Jurisdiction and Dispute Resolution

16.1. The party you are contracting with and the seller of the products and services offered and sold on this Site is Galaxy Enterprises (NT) Pty Ltd trading as BB My Champ.

16.2. All matters relating to your access to or use of this Site shall be governed by the laws of the Northern Territory, Australia. You agree that the United Nations Convention on Contracts for the International Sale of Goods will not apply to any sale under these BB My Champ Terms.

16.3. Any legal action or proceeding relating to or arising from your access to or use of this Site shall be instituted in Darwin, Australia. You agree to submit to the jurisdiction of courts situated in Darwin, Australia, and agree that venue in these courts is proper in any such legal action or proceeding. You also agree that you not assert, in any legal action or proceeding involving BB My Champ, that a court sitting in Darwin, Australia is an inconvenient forum for such legal action or proceeding.

16.4. Some jurisdictions provide for certain warranties, like the implied warranty of merchantability, fitness for a particular purpose and non-infringement. To the extent permitted by law, we exclude all warranties. When permitted by law BB My Champ, and BB My Champ’s suppliers and distributors, will not be responsible for lost profits, revenues, or data, financial losses or indirect, special, consequential, exemplary, or punitive damages.
